Investigators from the Lviv State Bureau of Investigation prevented the illegal import of large quantities of contraband goods and caused damage to the interests of the state in the amount of more than 4.7 million hryvnias ($168,000).
According to a report on the State Bureau of Investigation of Ukraine (SBIU) website, on December 4, 2020, while leaving the Krakivets international road checkpoint, a commercial truck was detained, which was moving to the internal customs to complete customs formalities. It was established that he entered Ukraine using forwarding documents, which reflected inaccurate information about the merchandise marks and the cost of motor and gear oils.
“Due to the fact that the merchandise marks of these goods are included in the customs register of intellectual property rights, in order to avoid additional costs during their customs clearance, individuals deliberately reflected in the documents merchandise marks of much lower value, which are not in the register. Thus, 45% of the goods did not comply with the accompanying documents”, – the statement said.
According to the preliminary customs declaration and accompanying documents, the value of motor and gear oils imported into the customs territory of Ukraine is underestimated approximately 7 times, which is more than UAH 4.7 million. This could cause losses to the state budget of Ukraine in especially large amounts.
It was also established that the officials of the customs post “Yavoriv” of the Galician State Customs Office of Ukraine after the operation of the automated risk analysis and management system (ARAMS) for non-compliance of weights, did not properly inspect the above products and issued a permit to leave the vehicle. .
Currently, the owners of the goods are trying to take it out of the customs territory of Ukraine.
Thus, a crime was committed on the fact of tax evasion, fees (mandatory payments) (Part 1 of Article 212 of the Criminal Code of Ukraine); unlicensed interception or copying of information processed in computers, automated systems, computer networks or stored on the media of such information, if it led to its leakage, committed by a person entitled to access such information (Part 2 of Article 362 of the Criminal Code of Ukraine); and also official forgery (part 2 of Article 366 of the Criminal Code of Ukraine).
Similar facts of customs clearance of the goods of the specified carrier are checked and the request for rendering of the international legal aid of the Republic of Poland is prepared.
