The press service of the prosecutor’s Office of the Kyiv city reported that law enforcement agencies are trying to return to the state two dormitories of the National Aviation University, which four years ago were illegally alienated in favor of a commercial structure.
According to the report, the premises of two dormitories on Vitriani Hory street in Kyiv with an area of more than 2 thousand square meters and a cost of more than 12 million hryvnias ($444 000), which were on the balance sheet of the National Aviation University, in 2016, on the basis of a number of forged and worthless documents and contracts, illegally became the property of a commercial structure.
In this regard, in December 2016, the Kyiv local prosecutor’s Office No. 7 filed a lawsuit to claim extracting of dormitories to the state. Interestingly, the Podolsky District Court of Kyiv on 30.11.2017 and the Kyiv Court of Appeal on 21.03.2018 refused to approve the prosecutor’s claim.
Not agreeing with these court decisions, the prosecutor’s office of the city of Kyiv appealed them to the Supreme Court. The Court of Cassation instance, supporting the position of the Metropolitan prosecutor’s office, overturned the decision of the Kyiv Court of Appeal and sent the case for reconsideration to the court of appeal, noting that the prosecutor chose the right way to protect the interests of the state.
“The prosecutor’s office of the city of Kyiv will take all measures to prove in court the legal position on the need to return dormitories to state ownership,” the report says.
