Three police investigators who working in one of the police departments of National Police in Donetsk region are suspected of torture.According to SBI website, prosecutors of the office of prosecutor general and investigators of SBI territorial administration in the city of Kramatorsk informed police about the suspicion. Crime is punishable according to Part 2 of Art. 127 of the Criminal Code of Ukraine.
In December 2019, in order to obtain a confession from a citizen of a crime of which he was suspected,law enforcement officers beat him with their hands for several hours, legs and a rubber stick on various parts of the body. Also, probably, the police strangled the victim with a plastic bag and threatened with the use of a stun gun. To overcome the resistance from the man, the suspects, they also tied his hands and feet with tape..
According to office of the prosecutor general on website, taking into account the practice of the European Court of Human Rights under Art. 3 of the Convention on Human Rights and Fundamental Freedoms, as well as the provisions of national legislation, as well as the provisions of national law, such actions by law enforcement officers of State Security Bureau “SBI” and office of the prosecutor general qualified as torture.
In the case of guilt, law officers face a sentence of imprisonment for a term of 5 to 10 years.
The procedural leadership in criminal proceedings is carried out by prosecutors of the special unit for combating torture by the office of prosecutor general and the prosecutor’s office of Donetsk region. Operational support is provided by the Department of Internal Security of National Police of Ukraine.
